Terms and conditions

1. Domain Name Registration

We will organise your domain name on your behalf (it will be registered in your name / business name) and then an ongoing fee will be due every year.

2. Content Provision

All images, company logos, and proof-read current text are to be provided by the client in electronic format (i.e., Word) Additional images, photographs, or text required for the website development will be billed to the client. Editing Fees: If changes to text and images already submitted are required, there will be a $30 fee to edit the page again.

3. Copyright Responsibility

Obtaining permission to use any copyright material is the responsibility of the client supplying the material. The website owner must obtain permission to use photographs, graphics, music, video, and text from the author, photographer, or artist.

4. Ownership and Hosting

The client owns all images and content. The website files on the hosting account belong to the client.

5. Payment and Invoicing

A 50% deposit is required to commence work, and final payment is expected on final delivery of the completed website. Payments can be made direct deposit. A $100 late fee will be applied if an invoice is overdue by 10 days, and the hosting account will be terminated if payment is not received 21 days after the due date.

6. Delivery and Development

Final delivery of the project will occur within 2 weeks from commencement, depending on the prompt delivery of content by the client. Additional requirements, such as extra forms, interactive items, search functions, or more complex pages, will be negotiated separately.

7. Email Setup

We create and set up your email within the cPanel. It is the owner’s responsibility to update their settings in their email program, but we can provide assistance if needed.

8. Domain Name and Web Hosting

We will organise your domain name on your behalf, and the ongoing biannual fee is required and non-refundable for the first year. If you change your hosting provider after the first year, no exit fees will apply. Acceptable Use Policy

9. Prohibited Content and Activities

The use of our services for any unlawful purposes, including the infringement of copyrights or trademarks, is strictly prohibited. Potential harm to minors, including child pornography, is also strictly forbidden.

10. Password Security

It is the client’s responsibility to ensure that a secure password is used. If a weak password is used, the account may be suspended until a more secure password is set.

11. Spam Policy

We have a zero-tolerance policy against sending unsolicited email, bulk emailing, and spam. Any user who sends out spam will have their account terminated with or without notice.

12. Payment Information and Invoicing

Clients are responsible for ensuring that their payment information is up-to-date and that invoices are paid on time. A $100 late fee will be applied if an invoice is overdue by 10 days, and the hosting account will be terminated if payment is not received 21 days after the due date.

13. Backups and Data Loss

Our servers provide daily backups, and we can restore your site for an additional fee if you accidentally delete your account or your site becomes infected.

14. Bandwidth Usage

You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.

15. Hosting Requirement

We do not build websites that are hosted on another server. Clients must purchase one of our hosting plans if they would like us to build their website.
